Terms of Service

These Terms of Service ("Terms") govern use of Church Engagement OS, operated by The Barrett Group LLC ("we," "our," or "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Church Engagement OS.

1. What Church Engagement OS Is

Church Engagement OS is a ministry engagement platform that helps churches manage people, households, giving, events, and communication in one system.

Church Engagement OS is not an accounting system, a bank, a payment processor in its own right, or a provider of legal, tax, or financial advice. Giving statements generated by the platform are informational records of donations, not legally-reviewed tax documents — churches and their members should consult their own tax advisor for questions about deductibility.

2. Who These Terms Apply To

Two distinct audiences use Church Engagement OS, and different sections below apply to each:

  • The church — the organization that subscribes to Church Engagement OS. The church is responsible for its account, its staff's use of the platform, and — as described in our Privacy Policy — is the data controller for the information its staff enters about members and guests.
  • Staff and members — individuals who log into a church's account, either as staff (Admin/Staff roles, with permissions the church configures) or as a member using self-serve access to their own information.

3. Eligibility

  • Staff accounts must be created and used by individuals at least 18 years old.
  • A church must have the legal authority to operate as the organization it represents and to record the information it enters about its members and guests.
  • Church Engagement OS is currently available to US-based organizations.

4. The Church's Responsibilities as Data Controller

Because the church controls what member and guest information is entered into the platform (see Privacy Policy, Section 1), the church is responsible for:

  • Having a lawful basis for collecting and storing the information it enters about members, visitors, and guests
  • Responding appropriately to a member's request regarding their own information, using the export and deletion tools we provide
  • Configuring staff permissions appropriately for its own organization
  • Not entering information it does not have the right to record

5. Accounts and Access

Each church controls who holds Admin and Staff roles in its account and what each person can see, through the platform's permission system. The church is responsible for the access it grants its own staff. Do not share individual login credentials.

6. Payment Processing

Platform subscription. If a church subscribes to a paid tier, payment is processed by Stripe. By subscribing, the church authorizes us to charge the designated payment method on a recurring basis, and agrees to Stripe's Terms of Service.

Member giving and event payments. If a church enables online giving or paid event registration, those payments are processed through Stripe Connect and settle directly to the church's own connected Stripe account. Church Engagement OS facilitates this technically but does not take custody of these funds. The church is responsible for its own Stripe Connect account and compliance with Stripe's requirements for it.

7. Acceptable Use

You may not use Church Engagement OS to:

  • Enter or store information you do not have the right to record
  • Attempt to reverse-engineer, scrape, or extract data from the service at scale
  • Circumvent or test security controls without written authorization
  • Upload or transmit malicious code
  • Use the service for any unlawful purpose, or to access another church's data without authorization

8. Data and Privacy

Use of Church Engagement OS is also governed by our Privacy Policy, which describes how information is collected, used, and protected, and clarifies the church's role as data controller. By using the service, you agree to the Privacy Policy.

9. Subscriptions and Billing

  • Pricing — available plans and current prices are shown at signup and on our pricing page. A free tier is available for smaller churches.
  • Billing cycle — paid subscriptions renew automatically at the end of each billing period unless canceled.
  • Cancellation — a church may cancel at any time from Settings. Cancellation takes effect at the end of the current billing period; access continues until then. We do not issue refunds for partial billing periods.
  • Price changes — we will notify a church by email in advance of any price change taking effect. Continued use after the new price takes effect constitutes acceptance.

10. Availability and Accuracy

We work to keep Church Engagement OS accurate and available, but make no guarantees. We may modify, suspend, or discontinue any part of the service at any time. Giving statements and reports are provided as informational records; see Section 1 regarding their limits as tax documents.

11. Disclaimer of Warranties

Church Engagement OS is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, The Barrett Group LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of Church Engagement OS, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the greater of $100 or the amount paid to us in the 12 months before the claim arose.

13. Indemnification

You agree to indemnify and hold harmless The Barrett Group LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of Church Engagement OS.

14. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Disputes will be resolved in the courts of North Carolina.

15. Changes to These Terms

We may update these Terms as the product evolves. For material changes, we will notify affected churches by email in advance of the change taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
